What is an ECCN?
An Export Control Classification Number (ECCN) is a five-character alphanumeric code that identifies items on the Commerce Control List (CCL) for export control purposes. The first character is a number (0-9) indicating the category, the second is a letter (A-E) indicating the product group, and the last three digits identify specific control reasons and item characteristics.
What does each part of an ECCN mean?
The five characters of an ECCN are structured as follows: The first digit (0-9) represents the category (e.g., 3 = Electronics). The second character (A-E) represents the product group (A = Equipment, B = Test Equipment, C = Materials, D = Software, E = Technology). The last three digits represent control reasons and sequential numbering.
What is the difference between ECCN and EAR99?
EAR99 is a designation for items that are subject to the Export Administration Regulations (EAR) but are not specifically described in any ECCN on the Commerce Control List. Most commercial products fall under EAR99 and generally do not require a license for export, unless destined for a sanctioned country, a prohibited end-user, or a prohibited end-use.
What is the Commerce Control List (CCL)?
The Commerce Control List is the list of items (commodities, software, and technology) subject to the export licensing authority of the Bureau of Industry and Security (BIS). It is found in Supplement No. 1 to Part 774 of the Export Administration Regulations (EAR).
Classification
How do I determine the correct ECCN for my item?
There are three ways to determine an ECCN: 1) Contact the manufacturer or developer of the item, 2) Self-classify by reviewing the CCL and comparing technical specifications, or 3) Submit a classification request to BIS through the SNAP-R system. For complex items, consulting with an export control professional is recommended.
Can I self-classify my items?
Yes, exporters can self-classify items by reviewing the Commerce Control List and determining which ECCN, if any, describes their item. However, self-classification requires understanding the technical specifications of your item and familiarity with the CCL structure. If uncertain, you can request an official classification from BIS.
What if my item doesn't match any ECCN?
If your item is subject to the EAR but is not described in any ECCN on the CCL, it is designated as EAR99. However, before concluding an item is EAR99, carefully review all potentially applicable ECCNs, including the "specially designed" catch-all provisions.
How long does a BIS classification request take?
BIS aims to process classification requests within 14 calendar days of receipt. However, complex cases may take longer. You can submit classification requests through the SNAP-R (Simplified Network Application Process Redesign) system.
Licensing
Do I need an export license?
Whether you need a license depends on several factors: the item's ECCN, the destination country, the end-user, and the end-use. Use the Commerce Country Chart in Supplement No. 1 to Part 738 to determine if a license is required based on the control reasons for your ECCN and the destination.
What are License Exceptions?
License Exceptions are authorizations that allow export or reexport of items subject to the EAR without applying for an individual license. Common exceptions include LVS (Limited Value Shipments), TMP (Temporary Imports and Exports), and TSR (Technology and Software Unrestricted). Each exception has specific conditions that must be met.
What are the penalties for export control violations?
Violations can result in civil penalties up to $300,000 per violation or twice the transaction value (whichever is greater), criminal penalties including fines up to $1 million and imprisonment up to 20 years for willful violations, and denial of export privileges.
